This determination will be made at a time when the California Tax Reform Coalition has a more neutral position on the effectiveness of the application of the section 501(c)(3) federal exemption. New Reg. 706.12 The state agency, not the Department, will determine where a specific exemption applies to an entity as a non-profit, but will make a ruling whether there is a “need” to be a non-profit. New Reg. 706.13 The agency will be the entity which determines where there is a need to be a non-profit. However, the state agency must act on the non-profit application promptly and will not be in a position to make this determination for at least 30 days between the date of its filing and the day it makes its ruling on Form 706. New Reg. 706.14 The agency must act on a non-profit's application timely. It must make a decision whether an entity qualified for registration within 120 days after the filing of the application.
